COMPLAINT FILED AGAINST COULTER VENTURES, LLC DBA ROGUE FITNESS

CENTRAL OHIO, DECEMBER 11TH, 2019- Attorneys with Barkan Meizlish DeRose Wentz McInerney Peifer, LLP and Marshall and Forman, LLC filed an updated collective and class action complaint in the United States District Court for the Southern District of Ohio in Columbus against Coulter Ventures, LLC DBA Rogue Fitness alleging that the fitness equipment manufacturer violated federal and Ohio wage laws. The updated complaint expands the suit to include employees in the manufacturing and customer service departments, and names the owners as Defendants.

The complaint alleges Rogue Fitness failed to pay their non-exempt employees overtime in violation of the Federal Labor Standards Act of 1938 (“FLSA”), 29 U.S.C. §§201, et seq., The Ohio Minimum Fair Wage Standards Act [“the Ohio Wage  Act”], O.R.C. §§4111.01., 4111.03 and 4111.10, and the Ohio Prompt Pay Act [“the OPPA”]. Specifically, the complaint states that non-exempt employees working in the Rogue Fitness warehouse were not properly compensated for all the hours they worked, as they were required to work before and after their scheduled shifts without compensation and for failure to pay correct overtime. 

Plaintiffs’ Attorney, Robert E. DeRose official statement:

“Wage theft in any form cannot be tolerated. These types of wage violations are far too common in the workplace. Workers should not have to go to the courts to be paid their fair wages. We intend on securing the unpaid wages and overtime for the current and former workers of Rogue Fitness with this lawsuit.”
