Paycheck Warriors at Barkan Meizlish, LLP file Complaint against Team Lubrication, DBA Jiffy Lube
On September 30, 2019 Barkan Meizlish, LLP filed a federal collective action Complaint against Team Lubrication, Inc. DBA Jiffy Lube, an automotive services company with six locations in central Ohio.
According to the Complaint, Team Lubrication DBA Jiffy Lube failed to pay employees for all hours worked including training modules and time to put on and take off their work uniforms before clocking in. As a result, the suit alleges, the Plaintiffs and other similarly situated individuals were not properly paid for all of their overtime hours worked.
The lawsuit is brought on behalf of current and former Team Lubrication DBA Jiffy Lube employees who worked as Technicians. Technician job duties include light vehicle maintenance such as oil changes, tire rotations, window cleaning, and upholstery cleaning. The Complaint covers those employees who were not properly compensated for all of their overtime hours worked in violation the Fair Labor Standards Act, 29 U.S.C. §§ 201 et seq. (“FLSA”) and the Ohio Minimum Fair Wage Standards Act, O.R.C. §§ 4111 et seq. (“Ohio Wage Act”). Under these laws, nonexempt employees must be paid overtime at a rate of 1.5 times their regular rate of pay for all hours worked in excess of 40 in a workweek.
Specifically, the Plaintiffs in this matter allege that they were not paid for attending “Jiffy Lube University” and “J-Team Training” prior to beginning work at locations in Central Ohio. In the Complaint, Plaintiffs state that such Jiffy Lube University Training Modules, as well as J-Team Training, including various training on orientation and safety, were unpaid by the company, and were required as part of their job. Plaintiffs also allege that they were not paid for work that occurred prior to the beginning of their shift and after the end of their shift. The Complaint alleges that this pre- and post- shift work included putting on and taking off required personal safety equipment required by the employer for the job.
