In a recent $135,000 settlement, the Arizona-based chain Chuy’s Mesquite Broiler was found at fault for multiple minimum wage and overtime violations. The 55 employees affected by these abuses against the Fair Labor and Standards Act will receive back pay for their lost wages pursuant to this settlement. The case has raised awareness and questions of whether these illegal pay practices were occurring at Chuy’s Mesquite Broiler locations across the country. The basis of the Arizona case was that employees were being paid cash or separate checks for straight-time instead of the legally required overtime payments. The federal investigation into Chuy’s practices in Arizona found that not only were employees cheated out of overtime pay, but that Chuy’s Mesquite Broiler also wasn’t complying with the federal minimum wage hours by paying employees at least $7.25 per hour for all hours worked. In fact, federal investigators also found violations by Chuy’s Mesquite Broiler for not tracking all hours actually worked by their employees.
Chuy’s Mesquite Broiler is a Tex-Mex restaurant chain, operating across the United States. With locations in Ohio that include West Chester, Cincinnati, Columbus, and Dayton, the chain spans throughout a significant portion of Ohio. There are also chains in various states across the country.

If your employer has ever withheld your paycheck, failed to track all your hours, didn’t pay you overtime, paid you less than time-and-a-half for overtime, otherwise improperly paid you, or falsified your hours or pay, you have been the victim of waged theft. Wage theft does not have one specific definition, as it can occur in multiple ways. Most wage theft violations fall under the category of Fair Labor Standards Act violations or state and/or federal minimum wage violations.
The Fair Labor Standards Act (or FLSA for short) is a federally mandate guideline regarding employer practices. The FLSA contains laws pertaining to employment practices, overtime pay and record keeping. Other various guidelines for exemptions can also be found in the FLSA. Employees affected by their employer’s non-compliance to the FLSA should pursue action and hold their employer accountable for their violations. Since the FLSA is a federal law, it requires that employers in every state comply with the same standards.
The federal government and your state may have different minimum wage standards. For example, federal minimum wage is currently $7.25 an hour, and the Ohio minimum pay rate for 2020 is $8.70. If you are unsure of your state required minimum wage you can consult this map to find your state’s rate.
